Like you, I would really like to know more about how complete (or
not) the coverage is. NYT Historical covers 1851 to 4 years ago,
so it goes through the years covered by the Tasini case and on
into the present day. My very rudimentary understanding of the
case is that the ruling relied on a provision in the Copyright Law
that basically states that the author retains copyright of the
individual work while the publisher may retain copyright to the
collective work. The databases at issue in the lawsuit were
text-based and offered up individual articles for searching
without presenting any of the original context, so the court
concluded that the articles did not qualify as a revision of the
collective work. NYT Historical appears to thread the needle by
making individual articles searchable but presenting only a PDF of
the complete newspaper page for actual viewing thus leaving the
"collective work" undisturbed and avoiding the need to secure
additional rights. However, I am not a lawyer and I could be
totally wrong!<br>

If there is missing content, I'd be curious to know how it's
presented--since each page is a full-page scan, are those areas
physically or digitally removed from the microfilm or the database
display?<br>

WRT to whether it's an enormous loss, it's my honest hope that
there are libraries somewhere preserving top-quality original film
reels with all the NYT content. For our own local needs, though,
the database barely gets enough use to justify its enormous annual
platform fee, so I don't feel any particular worry about the
potentially missing content or remorse for our long-ago withdrawn
film reels. (Just don't get me started on the film we discarded
for other journals because someone assumed unstable text-only
aggregator database content was a perfectly good substitute.

this piece is that the presence or absence of a freelance
writer’s article in the ProQuest Historical Newspapers The New
York Times does not necessarily prove that the digitized
version is faithful to the original, since it’s possible that
such an author might have agreed to redistribution rights. A
different freelance author who didn’t though, will likely not
have an article present in the digitized version since, as the
above article notes:<o:p></o:p></p>

contributions after the holding in Tasini may allow
freelancers to argue that publishers are knowingly
disregarding the law and are liable for enhanced damages for

has sources, please correct me. It’s an important issue in my
own mind since my library was one of those who chose to
discard its extensive backfile of microfilm for the NYT when
it purchased ProQuest Historical Newspapers The New York Times
(before my time), because of what I think was an erroneous
belief that there was complete coverage. It could be argued
that this isn’t an enormous loss, regardless, and it was
worthwhile to do for other reasons.<o:p></o:p></p>

other materials that were problematic from a copyright
perspective were removed. Also, microfilm produced subsequent
to that case no longer faithfully reproduced the original in
its entirety – in other words, stuff was excluded that was
problematic.<o:p></o:p></p>

that had microfilm holdings that were produced prior to the
Tasini case were “safe” in that they still held material that

I think the presence/absence of freelance articles, ads,
etc. is down to the presentation in the database (and how
the source was licensed). In the case of PQ's NYT
Historical database, they've actually reproduced the<b>
original microfilmed pages in their entirety.</b> This
gets around the Tasini case because the articles aren't
removed from the context of the collective work and also
happily means that ads, letters, and even features like the
crossword are present. Full text databases, including some
of PQ's other newspaper databases, that do not feature a
full "page view" PDF and just have the text of the article,
are the ones to be careful about when withdrawing
print/film.<br>
<br>
As always, do your homework and check carefully. I just did
a search in our PQ NYT Historical and found an article by
Jonathan Tasini himself, complete with an ad for the
Helmsley Palace (comparing it to the Taj Mahal--how
delightful).<br>
