[Eril-l] [EXT] Standardized licensing for single streaming video title purchases

Hi! We are using the following:

LIMITED PUBLIC PERFORMANCE (PPR)
This license permits unlimited single site, non-theatrical, non-commercial, non-broadcast, internal use by the purchasing organization only. No admission fees may be charged, and no public uses are permitted (screening or use of the DVD or Digital Media with others outside the purchasing organization) unless a commercial license is purchased. These rights are non-transferable.

DIGITAL SITE LICENSE
DSL allows the licensee to locally host and stream a film on a closed system to the licensee's authorized users. Licensee receives license to archive, preserve, conserve, stream, and otherwise make available the Copyrighted Material, under the condition that the licensee will take reasonable measures to ensure that the material is not made available outside the institutions own network.

USERS
The licensee agrees that the users for this license shall be restricted to [the institution's] affiliated users and that this license will not be included in any courses that could be sold to other institutions for future distance-education. Affiliated users include faculty, staff, students, and optionally walk-in and authorized alumni library users.

COPYRIGHT
All material is protected by copyright law. Violation of copyright law is a federal crime. No program in any format may be used for commercial purposes, broadcast, or cablecast without prior written consent. Nothing in this Agreement shall in any way limit the ability of the Authorized Users to engage in or conduct any activity that would not constitute an infringement under Canadian copyright laws, in respect of a copyrighted work.

For a Digital Site License purchased with a DVD, license allows licensee to create a file from the DVD that can be streamed through the licensee's closed system.

Hi Denise,

I have attached our sample streaming rights license for your review. I have removed institution specifics and have highlighted (in blue) some Texas related items that may be applicable to your institution depending on your local laws. I might pass this along to your legal team to see if they have any specific suggestions that might make this fit for your needs.

HI, I'm wondering if anyone has developed a license template or criteria for purchasing/leasing single streaming video titles? We have just begun to purchase (or lease) single steaming titles, and to convert DVDs for hosting in a proprietary platform (Films on Demand). I would like to create a standard set of terms for each producer/distributor to either include in their license or give their agreement.
